Please read these Terms of Service. These terms and conditions set out the terms and conditions for the use of whir-mixer.com (hereinafter "Whir"). Using the Whir Service, visiting the Website and sending Bitcoin anonymously means that you accept and agree to these Terms. Whir reserves the right to update these Terms at any time by posting revised Terms on the Site. Such changes shall take effect on the date of their publication on the Website.

1. Bitcoin and Whir

1.1 Information about the Bitcoin network

Our service does not send or receive money independently; we only organize the interaction within the Bitcoin network according to the conditions set by you.

Once the Bitcoin network has identified the information about the transaction you sent, the information will be transferred to other users and companies on the Bitcoin network.

The service cannot be used to terminate Bitcoin transactions or receive money back.

1.2 Bitcoin risks

Whir has no control over and makes no representations regarding the security of the Bitcoin network. You acknowledge that there is a risk in using the Bitcoin network. We cannot be held responsible for lost profits.

The Bitcoin transaction may remain unconfirmed for a period of time (usually less than an hour, but occasionally up to several days). It can never be completed if it remains "unconfirmed".

1.3 Whir service working arrangements with end customers

The service organizes a non-public transfer from a generated deposit address to the recipient address. The Service shall not be liable for any operations beyond those described on its website or in these Terms. This includes sending Bitcoin illegitimately to the service address, resending it, or delaying in confirming your transaction.

1.4 Your passwords and security

Whir does not have access to your Bitcoin wallets that you have used to send or receive cryptocurrencies. Consequently, the entire responsibility for the use of your wallets lies with you. If you need advice on irregularities, do not hesitate to contact us.

1.5 The minimum age to use the Service

You must be over 18 years of age or above the minimum age required by law to use the Whir Service.

1.6 Taxes

Taxes are your sole responsibility. You need to be aware of whether Bitcoin or cryptocurrency transactions are subject to your region's tax regulations. All questions related to reporting to the tax authorities and paying taxes are entirely up to you. Whir is not responsible for such matters and does not provide advice on tax matters that may arise from the transactions executed.

2.2 Suspension or Termination of Services

Whir reserves the right to suspend or terminate access to the Services at any time in its sole discretion, with or without cause, with or without notice, and assumes no responsibility whatsoever. Services may be suspended or terminated for the following reasons, for example:

    an actual or suspected breach of these Terms;
    Use the Service in a manner that results in Whir's legal liability or a malfunction of the Service;
    planned or unplanned maintenance work.

2.3 Unacceptable use

You agree that you will not commit, encourage or endorse any of the following:

Using unauthorized means to access the Whir Service or using automated processes or services (e.g., spiders, crawlers, or periodic caching of information stored or generated by Whir);

Pursuant to these Terms, you will not be granted any ownership or possession rights with respect to the Service. Whir reserves all rights not expressly granted.

The control user exists regardless of the 3-user limitation.

3.1 Responsibilities

the sole responsibility for the nature, quality and accuracy of the User Data submitted to the Service;
You'll quickly see and respond to all notifications and requests related to user data and operations, including all notifications sent to you from our Help Center.

You will not store or transmit any improper information, including:

illegal, defamatory, threatening, pornographic, abusive or otherwise unacceptable materials of any kind;
Materials that solicit illegal acts that may constitute a criminal offense or violate intellectual property rights, the right of publicity, or the privacy of others;
any material that contains or uses software viruses or other harmful or harmless computer codes, files or programs such as Trojans, worms, bots or spyware that may harm, endanger or suppress other persons, organisations or Whir.

WHIR SHALL NOT BE LIABLE FOR ANY LOSS INCURRED BY YOU OR ANY THIRD PARTY AS A RESULT OF YOUR USE OF THE SERVICE.

WHIR IS UNABLE TO ASSURE SATISFACTORY QUALITY OF SERVICE, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF RIGHTS.

SOME JURISDICTIONS DO NOT ALLOW THE ABOVE EXCLUSIONS. IN THIS CASE, THESE EXCLUSIONS HAVE NO EFFECT ONLY WITHIN THE LIMITS PROHIBITED BY THE APPLICABLE LEGISLATION.

4.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL WHIR, ITS EMPLOYEES, AGENTS, PARTNERS, VENDORS, LICENSORS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INTENTIONAL OR OTHER DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFIT, REVENUE, REPUTATION) INCURRED IN THE USE OF THIS SERVICE.
